In a victory for those of us with the inclination to express our displeasure with fellow motorists in a gesture, a Texas Court overturned Robert Lee Coggin's conviction for making. an offensive gesture in a public place
This case however, illustrates a greater problem with the US legal system than one would think. This man, found guilty of behavior performed by millions on a daily basis, fining him $250 under an obscure (and arbitrarily-enforced) statute.
Well that only $250, you say? Yes, but it cost him $15,000 to reaffirm his right (and, consequently ours) to give people the bird. That's because the legal system requires that one be ready to shill out large sums of money to pay for ridiculously expensive lawyer fees for anyone to seek to clear their name of charges.
The State knows this. And it doesn't care. Because the fact that to get a $250 fine reversed, requires a $15,000 commitment (non-refundable, natch.) That's how it secures revenue streams based on laws of dubious Constitutional merit.
It's like the "drive-thru": They f*ck at the drive through because they know you're not going to go back and complain. The city f*cks you with some silly charge to raise revenue, because they know it's gonna cost you 60 times the silly fine to challenge it in court, and most people won't go through with it.
